Kidneys cannot be directed - Division of Labour

Robert Colavito had a kidney donated to him by a dying friend. The kidney meant for Colavito was found unusable after the other donated kidney had already been transplanted into another patient. Colavito sued the hospital for misdirection of the kidney. Judge Dora Irizarry decided that Colavito did not have a cause of action because public policy discourages the treatment of organs as private property.
Division of Labour asks the requisite question from the economist's corner: why not private property in organs? Yes, why not?
